Terms of Service

These terms are a contract between you and ScaleCraft LLC. They apply whenever you use Crewmint. Please read them. By creating an account or using the service you agree to them, including our Data Processing Addendum, which forms part of these terms.

Who we are

Crewmint (crewmint.ai) is a product of ScaleCraft LLC, a Wyoming limited liability company, 312 W 2nd St Unit #A9117, Casper, WY 82601, USA. In these terms "we", "us" and "our" mean ScaleCraft LLC. "You" means the person or business using Crewmint.

If you accept these terms for a company or other organisation, you confirm you have authority to bind it, and "you" includes that organisation.

Accounts and eligibility

You must be at least 18 years old and use Crewmint for business or professional purposes. It is not a consumer product.

Give us accurate account details and keep your login secure. You are responsible for everything done under your account and in your workspaces, including by teammates you invite. Tell us straight away at help@crewmint.ai if you think someone has accessed your account without permission.

Plans, credits and renewals

The Free plan costs nothing. Paid plans are billed in advance, monthly or yearly, at the price shown when you subscribe. Prices are in US dollars and exclude any taxes we are required to collect.

Each plan includes a monthly allowance of credits. Credits are used when your AI teammates do work, such as replying in chat or running a tool. Unused monthly credits do not roll over. Extra credits bought as top-ups are added to your workspace and are not refundable once used, except as set out in our Refund Policy.

Subscriptions renew automatically at the end of each billing period at the same price you signed up at. We will not raise the price of an active subscription at renewal. If you change plans, the price of the new plan applies from that change.

You can cancel anytime from the Billing page. Cancelling stops the next renewal. You keep access to your paid plan until the end of the period you have already paid for, then your workspace moves to the Free plan.

Refunds

If you are not happy, you can get a full refund within 14 days of any subscription charge, for any reason and with no questions asked. Our Refund Policy explains how it works.

Acceptable use

You must use Crewmint lawfully and responsibly. You must not use it to:

send spam, or any bulk or unsolicited messages that break the law or the email and outreach rules below;

send or host malware, phishing pages or any code designed to harm devices or get unauthorised access;

create, store or share illegal content, or content that is defamatory, hateful, harassing or sexually explicit, or that infringes anyone else's intellectual property, privacy or other rights;

impersonate any person or business, or hide or misrepresent who you are or who a message is from;

use the AI to create deceptive content, such as fake reviews or testimonials, made-up quotes, fake images or audio of real people, or false or misleading claims about products, prices or results;

misuse ad, social or other accounts you connect, including posting, spending or changing settings in ways the account owner has not authorised;

break into, probe, overload or interfere with the service or any connected system, or try to get around usage limits or security controls;

build a competing product from our service, or resell it without our written permission.

When you connect a platform such as Meta, Google, LinkedIn or TikTok, that platform's own terms, policies and advertising rules also apply to you. You are responsible for following them.

Email and outreach rules

These rules apply whenever you use Crewmint to email or message people outside your workspace, including cold outreach sequences. You are responsible for having a lawful basis for every contact you add, import or message, and for following the laws that apply to you and to the people you contact. These include the EU and UK GDPR, the EU ePrivacy rules as each country applies them, the UK PECR, the US CAN-SPAM Act and Canada's Anti-Spam Legislation (CASL).

No bought or scraped consumer lists. Do not upload, import or message lists of private individuals that you bought, rented or scraped.

Business contacts only. Cold outreach is allowed only to business email addresses of people in their work role, where you have a lawful basis (such as legitimate interest) and the message is relevant to their job. Do not send cold outreach to personal email addresses.

Honour opt-outs. Every message must offer a simple way to unsubscribe or object. Stop contacting anyone who opts out promptly, and in any case within 10 business days, and never add them back to a campaign.

Say who you are. Every message must clearly identify you or your business as the sender, use accurate From and subject lines, and include a valid postal address for your business.

Germany. Under German law (section 7 of the Act Against Unfair Competition, UWG), advertising email to businesses in practice needs the recipient's prior consent. Do not send cold email to recipients in Germany unless you have that consent.

Canada. CASL requires consent before you send a commercial message. Implied consent applies only in narrow cases, for example where the person has openly published their business email address for their role, has not said they do not want messages, and your message is relevant to that role. Otherwise get express consent first, and keep a record of how you got it.

Other countries may have stricter rules. Where the law of the recipient's country requires prior consent, get it before you send.

We may pause sending, disconnect a mailbox or suspend your account if your messages cause high bounce or complaint rates, are reported as spam, or break these rules.

AI output

Crewmint uses artificial intelligence to draft content, analyse data and suggest actions. AI output can be wrong, incomplete, out of date or unsuitable for your purpose. It is not legal, financial, tax or other professional advice.

You are responsible for reviewing output before you publish, send or act on it. Nothing is posted, sent or changed on a connected account without your approval, unless you have set up an automation that you approved to do so.

Your content

You own the content you put into the service (such as your knowledge base, files, messages, leads and connected-account data) and the output your teammates create for you, to the extent the law allows.

You give ScaleCraft LLC a limited licence to host, copy, process and transmit your content only as needed to run, secure and support the service for you, including sending it to the subprocessors we use. We do not use your content to train AI models.

You confirm you have the rights you need to upload your content and to let us process it this way.

Data protection

For personal data in your workspaces, such as your contacts, prospects and leads, you are the controller and we process that data for you as your processor. Our Data Processing Addendum sets out how, and accepting these terms means you accept it. You are responsible for the lawful basis of the contacts you add.

We store this data on our own server in Frankfurt, Germany. The companies that help us run the service are listed on our Subprocessors page. How we handle your own account data is explained in our Privacy Policy.

Third-party integrations

The service can connect to third-party products, such as ad platforms, social networks, email and storage tools. Those products are run by other companies under their own terms. We are not responsible for them, their availability or changes they make. You can disconnect an integration at any time.

Suspension and termination

You can stop using the service and delete your account at any time from Your account in the app.

We may suspend or close your account if you break these terms, do not pay, put the service or other users at risk, or if the law requires it. Where reasonable we will tell you first and give you a chance to fix the problem. If we close your account without cause, we will refund any prepaid fees for the unused period.

Disclaimers

We work hard to keep Crewmint reliable and useful, but the service is provided "as is" and "as available". To the extent the law allows, we make no other promises, including that the service will be uninterrupted or error free, or that it will produce any particular business result.

Limitation of liability

To the extent the law allows, ScaleCraft LLC is not liable for any indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill, arising from your use of the service.

Our total liability for all claims relating to the service is limited to the fees you paid us for Crewmint in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in Wyoming, and both of us agree to their jurisdiction.

Changes to these terms

We may update these terms from time to time. If a change is significant we will tell you by email or in the app at least 14 days before it takes effect. If you keep using the service after that date, the new terms apply. If you do not agree, you can cancel before then.
